If you do not agree and accept all of the terms and conditions then you may not sign up for an account and you shall not have the right to play HeruNovus or browse the Site. You agree that you are liable for all activitoes conducted through the Account, and are responsible for ensuring that you are aware of the terms of this agreement. We hereby disclaim any and all responsibility and liability for any unauthorized use of your account.

These Materials include, but are not limited to, the content, information, illustrations, artwork, organization, compilation, design, layout, appearance, graphics and other copyrightable elements. It is a privilege to use and or otherwise view this site and its contents and as such, the privilege may be revoked either for a period of time or forever as we see fit. We may revoke this privilege for any reason whatsoever.

We hereby grant you a personal, non-exclusive, revocable, non-transferable license to use and display, for noncommercial and personal use only, copies of the Materials that are downloadable from this Site provided that "Copyright 2006-2009 HeruNovus.com. All Rights Reserved. Used With Permission" accompanies all copyrightable Materials.

Each separate user is allowed one account. If any accounts are created after the first, even if the first account is not activated or was ever accessed, or is suspended, all accounts, except the first, associated with the user will be suspended.


User Submitted Materials

By uploading or otherwise submitting any materials to us and/or the Site, you (and your parents, if you're under the age of 18) automatically grant (or warrant that the owner of such rights has expressly granted) us a royalty-free, irrevocable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, or use in any way we see fit. Communication and Online Conduct


Any ideas, messages, information, and opinions ("Postings") found on our website in chatrooms, the shoutbox, message boards ("Forums"), private messages ("Heru-Messages"), and in other user submitted Postings (Such as but not limited to, profiles, descriptions, shops, clans and pets) do not necessarily reflect the views of HeruNovus and its staff. Users remain solely responsible for the content of their Postings and therefore we reserve the right to edit, delete, modify, change in any way or refuse to post any Posting that we do not see fit for our Site.

You will violate the Terms of Service if you (or others using your Account) do any of the following:

• Post, transmit or distribute any profanity, obscenities, sexual or illegal content (expressed or implied)
• Mention and/or post any religious, political, or social commentary.
• Promote competing websites, or websites run by banned users. This includes requesting staff or volunteers for any Web site other than a HeruNovus fan site.
• Harass, Abuse, threaten, embarrass, or do anything else to another member or guest that is unwanted.
• Posting slanderous, defamatory, pornographic, infringing, invasive, threatening and harassing suggestions, comments and/or images
• Impersonate another person (including celebrities, politicians and other public figures), and/or indicate that you are a HeruNovus staff or that you represent HeruNovus.
• Solicitation of user passwords, account information, or other private information.
• Upload or submit any software or content that you do not own or have permission to freely distribute
• Post messages for any purpose other than personal communication. Posting chain mails, advertisements, promotional materials, or pyramid schemes is violating the Terms of Service.
• Abuse of a glitch knowingly or unknowingly.
• Use of programs that are utilized to cheat, hack, or unfairly win items, "HeruCoins", or other virtual goods.
• Making any commercial use of our Site and/or services. This includes but is not limited to the buying or selling of virtual goods such as HeruCoins, items, pets or artwork. USING OUR MATERIALS FOR MONETARY GAIN IS AGAINST THESE TERMS AND WE WILL TAKE SERIOUS LEGAL ACTION.
• Post/Send any information that we deem to be inappropriate for the Site.

Online conduct and communication should be guided by common sense and basic etiquette. This means: Be Nice! Don't be a jerk, and don't break the law!


Indemnification

You agree to indemnify, defend and hold HeruNovus and their respective owners, employees, volunteers, agents, attorneys and advertisers harmless from any liability, loss, claim or expense, including reasonable attorneys' fees, related to your use of the Site or violation of this Agreement.

This site is controlled and operated by HeruNovus owners, volunteers, and staff from locations within the United States of America.
